Terms of Service

1. Services
PresenceCraft provides website design, search engine optimisation (SEO), Google Ads management, and related digital marketing services to small and medium businesses in South Africa. Specific scope, deliverables, timelines, and pricing are agreed upon in writing before work commences.
2. Payment Terms
Website design projects require a 50% deposit before work begins, with the remaining 50% due upon completion and before the site goes live. Monthly services (SEO, hosting, ads management) are billed monthly in advance. All prices are quoted in South African Rand (ZAR) and exclude VAT where applicable.
3. Client Responsibilities
You are responsible for:
- Providing accurate business information, content, and assets in a timely manner
- Reviewing and approving deliverables within agreed timelines
- Ensuring all content provided does not infringe third-party rights
- Maintaining your domain registration and any third-party accounts you own
4. Intellectual Property
Upon receipt of full payment, you own the final website design and content created specifically for your project. PresenceCraft retains the right to display completed work in our portfolio and marketing materials unless otherwise agreed in writing. Third-party tools, fonts, plugins, and frameworks remain subject to their respective licenses.
5. Hosting and Domain
Domain names are registered in the client's name and remain the client's property. Hosting services are provided on a month-to-month basis. Termination of hosting requires 30 days' written notice. PresenceCraft is not responsible for data loss resulting from client-initiated cancellation.
6. Ads Management
Google Ads and social media ad spend is paid directly by the client to the advertising platform. PresenceCraft's management fee covers campaign strategy, setup, and optimisation only. Performance results depend on budget, market conditions, and factors outside our control. We do not guarantee specific results.
7. Limitation of Liability
PresenceCraft's liability for any claim arising from our services is limited to the fees paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
8. Termination
Either party may terminate ongoing services with 30 days' written notice. Work completed up to the termination date will be invoiced at the agreed rate. Deposits for project-based work are non-refundable once work has commenced.
9. Governing Law
These terms are governed by the laws of the Republic of South Africa. Any disputes will be resolved in the courts of Johannesburg, Gauteng.
